Terms of Service

Effective July 9, 2026

These Terms of Service (the "Terms") are a binding agreement between you and Faskit, Inc., a Delaware corporation doing business as Fask ("Fask", "we", "us", or "our"). They govern your access to and use of our websites, platforms, applications, and related services (together, the "Services"). By accessing or using the Services, or by clicking to accept these Terms, you agree to be bound by them. If you are entering into these Terms on behalf of a company or other organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

1. The Services

Fask provides AI agents that operate across the systems and channels your business already runs, including but not limited to:

  • AI agents for multi-channel business communication (phone, SMS, email, and web forms)
  • Integrations with CRMs, ERPs, and other business tools
  • A multi-tenant platform with isolated, access-controlled agent workspaces
  • Team automations and natural-language agent instructions
  • APIs and related developer tooling

We may update, add to, or discontinue features of the Services from time to time. We will not materially reduce the core functionality of a paid subscription during its then-current term.

2. Accounts and Registration

To use most features of the Services you must register for an account. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly at team@fask.ai if you suspect any unauthorized use.

3. Integrations and Third-Party Services

The Services connect to third-party products, platforms, and AI providers that you choose to enable ("Third-Party Services"). Your use of any Third-Party Service is governed by that provider's own terms and privacy practices, and we are not responsible for the availability, accuracy, security, or conduct of any Third-Party Service. You are responsible for maintaining the rights and credentials necessary to connect the Third-Party Services you enable.

4. Customer Data and Ownership

As between you and us, you retain all right, title, and interest in the data you submit to, or that is generated on your behalf through, the Services ("Customer Data"). You grant us a limited, non-exclusive license to host, process, and transmit Customer Data solely to provide and support the Services and as otherwise described in our Privacy Policy. We own all right, title, and interest in the Services, including all related software, models, and intellectual property, excluding Customer Data and Third-Party Services.

5. Acceptable Use

You agree not to, and not to permit any user to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property or privacy rights of others
  • Transmit unlawful, harmful, or deceptive content, or send spam or unsolicited communications
  • Attempt to gain unauthorized access to, or disrupt, the Services or their underlying systems
  • Reverse engineer the Services or use them to build a competing product
  • Use the Services to make automated communications in violation of the TCPA, CAN-SPAM, or similar laws

6. Fees and Payment

Paid subscriptions are billed in advance on the cadence stated in your order or plan. Fees are non-refundable except as expressly set out in these Terms or required by law. Unless stated otherwise, fees are exclusive of taxes, which are your responsibility. We may revise pricing for a renewal term with at least 30 days' notice before that term begins.

7. AI Output

The Services use AI models to generate responses, actions, and other output ("Output"). Output may be inaccurate, incomplete, or otherwise unsuitable for a given purpose, and it may be similar to output generated for other customers. You are responsible for reviewing Output before relying on it, and you should not use Output as the sole basis for decisions that carry legal, financial, or safety consequences without human review.

8. Service Availability

We work to keep the Services available and performant, but we do not guarantee uninterrupted access. We may suspend access temporarily to perform maintenance or updates, or where necessary to protect the security or integrity of the Services, and we will use reasonable efforts to limit any disruption.

9. Term and Termination

These Terms remain in effect while you use the Services. You may stop using the Services at any time. Either party may terminate a subscription for material breach that remains uncured 30 days after written notice. Upon termination, your right to access the Services ceases, and we will make Customer Data available for export for a limited period before deleting it in accordance with our Privacy Policy. Sections intended to survive termination, including ownership, disclaimers, limitations of liability, and indemnification, will survive.

10. Disclaimers

Except as expressly stated in these Terms, the Services are provided "as is" and "as available", and we disclaim all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be error-free or that Output will be accurate.

11. Limitation of Liability

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or related to these Terms, even if advised of the possibility. Except for your payment obligations and either party's indemnification obligations, each party's total liability arising out of or related to these Terms will not exceed the amounts you paid us for the Services in the 12 months before the event giving rise to the liability.

12. Indemnification

You agree to defend, indemnify, and hold harmless Faskit, Inc. and its officers, directors, and employees from any third-party claims, damages, and expenses (including reasonable legal fees) arising from your Customer Data, your use of the Services in violation of these Terms, or your violation of applicable law.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and each party consents to venue in those courts.

14. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will notify you by email or through the Services before the change takes effect. Your continued use of the Services after the effective date of an update constitutes acceptance of the updated Terms.
