1. Acceptance of Terms
By accessing and using Fask AI ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
Fask AI provides AI-powered customer experience and automation services, including but not limited to:
- AI concierge agents for customer interactions
- Voice calling and communication automation
- Data processing and analytics services
- Integration and API services
3. User Accounts and Registration
To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
4. Payment Terms
Subscription fees are billed in advance on a monthly or annual basis. All payments are non-refundable except as expressly stated in these terms. We reserve the right to modify our pricing with 30 days notice.
5. Data Processing and Privacy
You retain ownership of all data you provide to the Service. We process your data solely to provide the Service and in accordance with our Privacy Policy. You are responsible for ensuring you have the right to share any data with us.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit harmful, offensive, or inappropriate content
- Attempt to gain unauthorized access to our systems
- Use the Service for spam or unsolicited communications
7. AI and Third-Party Services
Our Service utilizes third-party AI services and providers, such as OpenAI, Llama, and other model providers. We also integrate with communication services such as Twilio and other third-party platforms. While we strive to ensure reliable service, we cannot guarantee the availability or accuracy of third-party AI responses or service availability. You acknowledge that AI-generated content may contain errors or inaccuracies.
8. Service Availability
We strive to maintain high service availability but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect service availability.
9. Data Retention and Deletion
We retain your data for as long as necessary to provide the Service. Upon request, we will delete your data within 30 days. We may retain anonymized data for service improvement purposes.
10. Limitation of Liability
To the maximum extent permitted by law, Fask AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use.
11. Indemnification
You agree to indemnify and hold harmless Fask AI from any claims, damages, or expenses arising from your use of the Service or violation of these terms.
12. Termination
Either party may terminate this agreement with 30 days written notice. Upon termination, your access to the Service will cease, and we will delete your data in accordance with our data retention policy.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
14. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new terms.
